Privacy Policy
Your privacy and security are important to us. We gather certain types of information from and about individuals who visit ActivityTree.com (the “Site”). This Privacy Policy covers what information we collect from you when you visit the Site, how we use it, and under what circumstances we disclose it. As used in this policy, “ActivityTree” refers to ActivityTree, its affiliates, members, directors and employees. By using the Site, you agree with the terms and conditions of this Privacy Policy and the Terms of Use.
1. Information Collected
When you use the Site, we receive and collect certain information. The information that we receive and collect depends on what you do when you visit the Site.
Automatically Collected Information. Some information is automatically received and sometimes collected from you when you visit the Site. We receive and collect the name of the domain and host from which you access the Internet; the Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access our site; and the Internet address of the web site from which you linked directly to our site. We use this information to monitor the usage of our site, administer our website and assist in diagnosing problems with our server. Also, when we send emails to you, we may be able to identify information about your email address, such as whether you can read graphic-rich HTML emails. All of the information we automatically capture provides us with the ability to enhance our customers’ search and purchasing experiences and to determine aggregate information about our user base and usage patterns.
Information Collected via Cookies. We use cookies to enhance the browsing and purchasing experience on the Site. “Cookies” are small files or records that we place on your computer’s hard drive to collect information about your activities on the Site. The cookies transmit this information back to the computers at ActivityTree.com; these computers are, generally speaking, the only computers which are authorized to read such information. The information captured makes it possible for us (i) to speed navigation, keep track of items in your shopping cart, and provide you with custom tailored content; (ii) to remember information you gave to us so you don’t have to reenter it each time you visit the Site; (iii) to monitor the effectiveness of advertising and marketing campaigns; and (iv) to monitor total number of visitors, pages viewed, and the total number of banners served.
Most people do not know that cookies are being placed on their computers when they visit the Site or most web sites because browsers are typically set to accept cookies. You can choose to have your browser warn you every time a cookie is being sent to you or you can turn off cookie placement. If you refuse cookies, you will not be able to open a ActivityTree.com Shopping Cart and therefore will not be able to complete an order with us online. Also, by not using cookies, your overall Internet browsing experience will be affected.
Information Collected Using Pixel Tags or Clear GIFs. To help us understand the effectiveness of certain of our email marketing efforts, ActivityTree.com may use “message format” and “message open” sensing technologies. Both technologies require the use of pixel tags or clear GIFs (also called web beacons). The “message format” sensing technology allows us to recognize whether you have enabled your email program to receive HTML emails; if so, this information is then associated with your email address so that subsequent messages can be sent to you in HTML format. The “message open” sensing technology allows us to recognize whether you have opened our email message. We can only detect this if you have enabled your email program to receive HTML emails.
Information You Actively Submit. For most of the browsing services we provide, we neither require nor collect “Personal Customer Information” -- your name, date of birth, email address, address, billing address, phone number, insurance information, medical information and credit card information. You can browse the Site and take as much time as you want to review our listings, services and reviews without having to submit such Personal Customer Information.
In the following instances, however, we do need you to actively submit Personal Customer Information: when you want to (i) create an account; (ii) add an item to your cart; or (iii) complete a purchase.
Creating an Account. You can create a password-protected ActivityTree.com account at any time while visiting the Site. To create an account, we require that you provide us with the following Personal Customer Information: your email address (which may not be associated with another ActivityTree ActivityTree.com account), your first and last names, your date of birth, address and phone number. We use your date of birth only to confirm you are 18 years of age or older. Individuals who are less than 18 years of age are not eligible to use the Site. You will also have to create a password. In addition, we ask you to provide the following information about the individuals who will be registering for activities: first name, last name, gender, date of birth, address and physical or other limitations.
Completing an Order. You must have an ActivityTree.com account to add an item to your shopping cart and complete an order. We use the Personal Customer Information stored in your account to complete the order. In addition, we collect your insurance information, medical information, emergency contact information and payment information. Payment information is used to bill you for products and services that you specifically request. We also capture information related to the services and goods you have purchased (“Purchase Information”).
Your Personal Customer Information and Purchase Information may also be used for a variety of purposes including (i) contacting you when necessary for customer service reasons, (ii) analyzing site usage, (iii) analyzing registration data, and (iv) marketing products and services. If you have an ActivityTree.com account, you can “opt-out” of receiving marketing communications from us. Log onto your Account, click on MyActivityTree, then click on Profile Settings and deselect the box “Special Offers and Promotions” and/or the box “ActivityTree Newsletter”.
2. Information Sharing
ActivityTree.com shares Personal Customer Information that we collect as follows:
Subcontractors. We send Personal Customer Information to third-party subcontractors and agents that work on our behalf to provide certain services. These third parties do not have the right to use the Personal Customer Information beyond what is necessary to assist us. They are contractually obligated to maintain the confidentiality and security of the Personal Customer Information and are restricted from using such information in any way not expressly authorized by ActivityTree.com. However, each such third party operates independently from, and may have privacy and security policies wholly different from, ActivityTree. ActivityTree bears no responsibility for the activities of any third party to whom ActivityTree may provide Personal Customer Information.
Activity Providers. We send Personal Customer Information and Purchase Information (other than credit card information) to third-party providers of services and goods that you may purchase from time to time on the Site, including Activity Providers. If you have opted not to receive Special Promotions and Offers these third parties may only use the Personal Customer Information and Purchase Information for the purpose of performing the services or delivering the goods you purchased. These third parties do not have the right to use the Personal Customer Information and Purchase Information beyond what is necessary to assist us or perform the services or deliver the goods you purchased. They are contractually obligated to maintain the confidentiality and security of the Personal Customer Information and Purchase Information and are restricted from using such information in any way not expressly authorized by ActivityTree.com. However, each such third party operates independently from, and may have privacy and security policies wholly different from, ActivityTree. Prior to purchasing services or goods offered by a third party, ActivityTree encourages you to contact the third party to review its privacy and security practices. ActivityTree bears no responsibility for the activities of any third party to whom ActivityTree may provide information.
Credit card companies. Credit card transactions are handled by a third-party financial institution and their vendors, which receive Purchase Information (including credit card information) and Personal Customer Information only to verify the credit card numbers and process transactions. These parties will also store this information until the transaction is complete or longer if you have elected to store your credit card information.
Law Enforcement Investigations. ActivityTree.com may release Personal Customer Information or Purchase Information when we believe, in our good judgment, that such release is reasonably necessary to comply with law, enforce or apply the terms of any of our policies or user agreements, or to protect the rights, property, or safety of ActivityTree.com, our users, or others.
Carpooling. If you have elected to participate in carpooling, ActivityTree will display your first name, and the distance you live from another ActivityTree user on the MyActivityTree/Carpool page. In addition, other users will be able to confirm that you have registered for the same activity. ActivityTree will not disclose or display any other Personal Customer Information in connection with carpooling. If you chose to contact another ActivityTree user regarding carpooling, ActivityTree will not disclose additional Personal Customer Information to the other user. Likewise, if you respond to a carpool request, ActivityTree will not disclose additional Personal Customer Information to the other user. If you elect to disclose personal information to another user via the carpooling feature you will be solely responsible any actions or communications stemming from your disclosure.
3. ActivityTree.com Communications
Communications related to transaction, account and website maintenance activities. By creating an ActivityTree.com account, you may receive communications from us relating to: account creation, order confirmations; order updates; order cancellation; important website information and material changes to site policies and account management procedures.
Other Communications from ActivityTree.com. As an ActivityTree.com account holder, we use your Personal Customer Information to communicate special offers, events, new products and services from ActivityTree.com via e-mail. Any ActivityTree.com account holder can opt-out from the receipt of any such communications or opt-out of certain communication methods by logging onto his or her Account, clicking MyActivityTree, then clicking Profile Setting and changing your preferences. You may also opt-out from the receipt of such communications by selecting the link at the bottom of any promotional e-mail communication and following the instructions.
4. Linking to third-party web sites
When you click on links and banners on the Site that take you to third-party web sites, you will be subject to the third parties’ privacy policies. While we support the protection of privacy on the Internet, ActivityTree.com cannot be responsible for the actions of any third-party web sites. We encourage you to read the posted privacy statement of any and every site you visit, whether you are linking from our site or browsing on your own.
5. Protecting your information
The Personal Customer Information you provide and you Purchase Information is secured using industry standard e-commerce security technology such as Secure Sockets Layer (SSL) encryption technology. We use this SSL technology to help prevent such information from being intercepted and read as it is transmitted over the Internet. The encrypted data goes to a secure site where your information is stored on restricted-access computers located at restricted-access sites. Although ActivityTree uses commercially reasonable efforts to safeguard your Personal Customer Information and Purchase Information, transmissions made by means of the Internet cannot be guaranteed secure in all instances. ActivityTree accepts no liability for disclosure of Purchase Information caused by transmission errors or the acts or omissions of third parties.
6. Unique E-mail, Password & Security Answer for ActivityTree.com Account
When you create an ActivityTree.com account, we secure your Personal Customer Information and Purchase Information in the following manner: (i) We cross check an e-mail address with the submitted password to validate access to any ActivityTree.com customer account, (ii) we do not allow any e-mail address to access more than one ActivityTree.com account, and (iii) when a new ActivityTree.com account is created, we require you to submit an e-mail address that is not associated with an existing ActivityTree.com account.
We encourage you to use a password that is not easily determinable (e.g., don’t use your name or street name). Keep your password; do not share it with anyone. The password and security answer are the “keys” to your account; anyone who gets these “keys” can, along with your e-mail address, gain access to your account.
If you forget your password, to gain access to your account you will need to have access to your e-mail account. On the Log On Page click on the Forgot your password? link and then type in the e-mail address of the account you would like to open. A message will be sent to your e-mail address with instructions on how to access your account and change your password.
If you want to change your password or other account information, simply log onto your account, Click on MyActivityTree, then click on Profile Settings.
7. Remember to Log Out
To further prevent unauthorized access to your account, remember that, after you Log on, you should Log Out once you have (i) completed your transaction, (i) completed managing your account, or (iii) decided to step away from your computer. Anyone who accesses your computer after you have logged in but before you have either logged out or your session has timed-out can access your account.
8. Changes to Policy
ActivityTree.com reserves the right to modify or amend this policy at any time by posting the revised Privacy Policy on our site. The changes will only affect the information we collect after the effective date of the change to our Privacy Policy unless we clearly express otherwise.
